Hayaikaze Kai Ken Puppy Contract
We are currently making changes to our contract-- these changes have not yet been reflected below.
Terms of Contract and Registration policies:
1) Buyer agrees to purchase the puppy described above under the following warranties and conditions. No other warranties or condition are neither expressed or implied.
2) Contract/warranties are only implied between the Breeder and the original Buyer, NOT to a third party.
3) Puppy is warranted only for the purpose of being a companion animal. While it may be capable of performing other functions, no warranty is given as to its fitness for any special purpose.
Purchase, Price, and Transport:
1) The Buyer has placed a $500 non-refundable holding fee towards the total purchase price of $____.
2) The remainder balance of $____ is due at the time of or prior to puppy pick-up/drop-off.
3) The Buyer has the option to have the puppy flown to them and will pay for associated costs (approximately $500 for crate, health certificate, and airline fees).
Veterinarian Examination:
1) The puppy’s health is excellent to the best of the Breeder's knowledge and belief at the time of this Contractual Agreement. Breeder will have had the puppy checked over by a veterinarian before sale of puppy.
2) Buyer is strongly encouraged to have the puppy examined by their own veterinarian within 18 (eighteen) days after physical possession of the puppy has been transferred. Failure to do so is an acceptance of health, anatomical make-up, appearance, & temperament of the puppy. Buyer agrees to provide written documentation to the Breeder from the veterinarian of their findings from the examination within 48 hours of the examination.
2.1) If the puppy is believed to be affected by a health condition, the Breeder has the right to request a second veterinary opinion including requesting the puppy be seen by her own vet. The Buyer must provide to the Breeder proof of the examination and all diagnosis with all phone numbers and names of treating Veterinarians.
3) Breeder shall not be held responsible for the development of any disqualifying faults, diseases or disorders.
4) All expenses regarding the puppy, including proper care, veterinary fees, housing, or legal expenses & liabilities are the sole responsibility of the Buyer.
5) Buyer must notify Breeder immediately if the puppy becomes sick, injured or dies. Breeder is to be notified before the puppy is put to sleep for any reason.
Nutrition/Vaccinations/Veterinary Care:
Your puppy is up to date on vaccinations and worming at the time you receive him/her.
Included in your puppy paperwork is a record that lists exact dates and what types of vaccinations/worming that were given. It is important that your puppy receive additional vaccinations necessary to keep it protected against infectious canine diseases.
1) Buyer agrees to follow all local, state and federal laws concerning canine vaccinations.
2) The Breeder is not responsible for any communicable diseases or reactions from vaccinations once the veterinarian has cleared the puppy in the first check up.
3) Buyer agrees to provide veterinary care when needed or as suggested by their veterinarian.
4) Buyer agrees to provide monthly heartworm and flea medication as directed by veterinarian.
5) Buyer agrees that by signing this contract that they give the Breeder full permission and authorization to speak to, request documents, disclose, and release, without restriction, all of the puppy’s health information and medical records regarding any past, present, or future medical condition from any veterinarian or technician that has treated this puppy at any time.
It is suggested that you do NOT take your puppy to dog parks, pet stores or other public places until they are at least 4 months of age and all vaccinations are completed. The risk of your puppy contracting Parvo-virus, Kennel Cough, Distemper and other communicable diseases is not worth the risk.
It is recommended that you set up playdates with known dogs in a safe and secure area. If you do take your puppy to public places, make sure to keep them away from heavily dog trafficked areas. Avoid rest stops and parks. Always supervise your puppy and keep interactions short and positive.
Health Warranty:
The puppy does not come with a health warranty. Kai Ken are a rare breed and still in the early stages of development in North America. The health of the breed is mostly unknown, a lot of the population is still young and most puppies/dogs are only a generation or two removed from imports.
The Breeder has done all recommended health tests on their dog’s. At the time of breeding and whelping the dam and sire were healthy. The Breeder and Buyer both promise to fully disclose any health issues encountered in the life of their Kai Ken. It is important to remain transparent when discussing health issues and concerns of Kai Ken so that new information can be used to make better decisions in the future.

If the puppy develops a genetic / hereditary disease or condition then terms of reimbursement or a replacement puppy will be discussed between the Breeder or Buyer. Reimbursement will not exceed the amount that was paid for the puppy ($____).
Breeding Rights:
This puppy is being sold with AKC FSS registration. The decision to spay or neuter is up to the Buyer. The Breeder recommends the puppy be kept intact for at least one heat cycle for females and preferably two years old for both males and females.
Kai Ken are a rare breed and preservation efforts are advanced by keeping dogs intact. If the Buyer has no intentions of breeding or making the puppy available to stud, then it is recommended to have the puppy spayed or neutered when they are of the appropriate age. If Buyer is interested in breeding or breed preservation, the Breeder will help guide the Buyer into making appropriate choices and advise the Buyer on what health tests to perform. The Buyer promises to notify the Breeder if they plan to breed the puppy.
Training:
1) The Buyer accepts the risks & responsibilities of training the puppy. The Buyer acknowledges that they have sole responsibility for ongoing, life-time socialization and training for the puppy as appropriate for its age.
2) Temperament is a product of many things, not simply genetics. Buyer accepts that much of a dog's temperament or eventual adjustment is determined by the skill & patience of the puppy's owner and how the puppy is raised or integrated into the new home/situation.
3) Breeder in no way warrants that the puppy will meet any specific training objective or achievement standard as desired or expected by Buyer. Goals are great things to have, but one cannot warrant luck, the future, training skill and the myriad other things which must be in place to achieve most goals. The accomplishments of a dog are also largely the result of training and the relationship between owner and dog. These are not things the Breeder can control, therefore are not things the Breeder will warrant.
First Right Of Refusal:
1) If at any time, for any reason, the Buyer finds that they are unable or unwilling to continue to care for the puppy, then the Buyer agrees to immediately contact the Breeder FIRST. The Buyer is required to inform the Breeder of such an issue as soon as possible.
2) Buyer agrees that at no time will they, without prior written permission from the Breeder, sell, give, trade, adopt, place, lease, foster, or re-home the puppy to any person, business, place or organization including allowing the puppy to be taken to a shelter or be sent to a rescue without the express written consent of the Breeder.
3) The Breeder will assist the Buyer with the issue if possible.
4) If the Buyer decides they do not want ownership of the puppy anymore, the Breeder will take ownership of the puppy. The Breeder is not liable to reimburse the Buyer.
